Initial trademark protection is usually established by simply selling your product into commerce and claiming your rights to the mark by adding a "TM" to it.
Frankly, you don't ever have to register your trademarks, but it doesn't cost much to do it, and once registered, you've got the power of the US government behind you.

Before you register your marks, you'll want to do a thorough search. This includes a search of all existing trademarks registered, unregistered or pending.

Marks may be filed as "in use" marks or "intent to use". When filing "intent to use" marks, you must put it in use before the PTO will register the mark.
Generally speaking the cost for an attorney to file, prosecute and complete the trademark registration process is usually between $1000 and $1500 depending on the complexity and whether or not the mark is challenged by the PTO. This cost is spread out over a 12- to 18-month period. Renewal fees for a trademark (every ten years) is currently $400.
